Partage Club Inc. (“Partage Club,” “we”, “us”, or “our”) is committed to protecting the personal information we collect, use, and share (collectively, “Process”) in connection with the Partage Club app ans website (partage.club or other websites we own that link to this privacy notice, the “Website”), services described in our Terms of Service (the “Service”) or other instances when you interact with us, such as sales, marketing or events.
This Privacy Policy describes when, why, and how we Process your personal information, and your rights relative to these activities. If you do not agree with our policies and practices, please refrain from using the Website or the Service.

1. WHEN DOES THIS PRIVACY POLICY APPLY ?
This Privacy Policy applies when you interact with us through the services described in this Privacy Policy or our Terms of Service, namely:
When you visit our Website and/or Application;
When you fill out a form on our Website and/or Application;
When you communicate with us through e-mail, phone, chat or social media;
When you use our Service;
When you participate at our events.
Our Privacy Policy does not apply to any third-party websites, tools or applications, even though we may link to them through our Website. Where applicable, it is your responsibility to ensure that you review and agree with these third parties’ policies and procedures. We encourage you to read the privacy policies of every website you visit. Any links to third-party websites or locations are for your convenience only and do not signify our endorsement.
2. WHAT IS PERSONAL INFORMATION ?
“Personal Information” means any information that allows someone to, directly or indirectly, identify an individual, including such things as name, identification number, address, phone numbers or financial information. Some jurisdictions use “Personal Data” to refer this concept. Personal Information does not include anonymous or de-identified aggregated information that cannot identify you as an individual. Not all information we collect is Personal Information.
3. WHAT PERSONAL INFORMATION WE COLLECT, AND WHY?
We collect Personal Information and other information from and about individuals who interact with us. We collect certain technical information automatically through your use of our Website and Service. We also collect information that you voluntarily provide us and through third-parties.

3.3. Using Website and Service
As you navigate through and interact with our Website or our Service, we use automatic collection technologies to collect certain information about your equipment, browsing actions, and patterns.
Information collected by our servers. To provide our Service and make it more useful to you, we (or a third-party service provider) collect information from you, including, but not limited to, your browser type, operating system, IP address, mobile device ID, and date/time stamps.
Log files. As is true of most websites and applications, our Website and Service gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and clickstream data. We use this information to analyze trends, administer the Service, and better tailor the Service to our users’ needs. For example, some of the information may be collected so that when you use the Service, it will recognize you and the information can be used to personalize your experience.
Do Not Track Signals. While we do not use any third-party cookies at this time, our systems recognize “do not track” signals from your browser that allow you to opt-out of tracking.

We may receive Personal Information about you from companies that offer their products or services for use in conjunction with our Service or whose products or services may be linked to our Service.
4. HOW DO WE USE YOUR PERSONAL INFORMATION?
We use your Personal Information to provide the Service, personalize your experience on the Website and the Service, improve the Service, and run our business in a compliant manner. We may also use your Personal Information in any other way we may describe when you provide the Personal Information.
4.1. Provide the service
Facilitate the creation of your account and to further secure your account

Display your username on our platform
Improve the administration of our Service and quality of experience when you interact with our Service, including analyzing how you and other users find and interact with the Service

5. WHAT ABOUT COOKIES ?
In this Privacy Policy, when we refer to “cookies” we also include other similar technologies such as pixels, tags and beacons. Cookies are small files used by web servers that are placed on your device when you visit a website in order to improve your online experience.
For example, they can remember your language preferences so that you always see websites in your preferred language first, they can keep you signed in so that you don’t have to re-enter your login information every time you visit a given website, and they can optimize the way a website’s displays based on your specific device or browser type.

We use the following type of cookies:
• Functionality: our Service uses cookies to ensure it functions properly, including page loads and remembering your user account, and tutorials to assist navigation.
• Performance and analytics: gather usage and performance data. This enables us to monitor and improve the Website’s performance, our Service, and your experience.
• Marketing: We use cookies to better provide more relevant offers and ads to our users. We also keep track of user data to refine our marketing strategies and tactics. Most marketing data is automated and anonymous.
5.2. CONTROLE THE COOKIES
If you wish to prevent cookies from tracking your activity on our Website or Service or visits across multiple websites, you can set your browser to block certain cookies or notify you when a cookie is set.
We only track your activity on our Website for our own analytical needs. We do not track visits across multiple websites or participate in targeted advertising. You may still decide to block cookies using your browser. If you block all cookies, some features that make our Service function property may not work and your experience may be affected.
6. WHERE DO WE STORE YOUR PERSONAL INFORMATION?
Your Personal Information is stored on our servers mainly located in AWS Canada. You consent to the transfer of information to other countries, which may have different data protection rules than Canada. Our practices regarding your personal information, even for data stored outside Canada, will at all times continue to be governed by our Privacy Policy and, if applicable, we will comply with applicable Canadian and Quebec laws (ex. Loi 25 - Nouvelles dispositions protégeant la vie privée des Québécois) to provide adequate protection for your Personal Information, no matter where it is stored.
7. IN WHAT CONTEXTS MIGHT WE SHARE YOUR PERSONAL INFORMATION?
Affiliates, service providers and partners. We may share your Personal Information with our affiliates, service providers and partners as part of the delivery of our Service or as part of our marketing activities. This is done in accordance with the purposes set out in this Privacy Policy or as permitted under applicable laws, as the case may be. We will require our affiliates, service providers, and partners to honour this Privacy Notice.
Business transfers. Because it is important for us that we have the flexibility and possibility to conduct our business, we may share and transfer your Personal Information without your permission where there is a corporate event requiring such transfer, such as a merger, acquisition, bankruptcy, sale of assets, or a reorganization of assets or operations. As part of this kind of event, we may share your Personal Information to the relevant third party (or its advisors) as part of any due diligence process or transfer to that reorganized entity or third party.
Advisors, auditors, law enforcement bodies and other competent authorities. To comply with our legal obligations or to defend our interests, we may share your Personal Information with third parties if we believe that disclosure is useful to enforce our Privacy Policy, to detect or prevent fraud, security or technical issues, or to comply with any applicable law, regulation, legal process, governmental request or certification scheme, or any other similar situation.
Other Disclosures. Where you’ve expressly consented to your Personal Information being shared with other third parties, we will Process it in accordance with such consent. For example, there may be specific instances where additional terms apply and, through these, we make clear that specific third parties will Process your Personal Information.
8. HOW LONG DO WE RETAIN YOUR PERSONAL INFORMATION?
We keep your Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required by law. We may retain your Personal Information as long as you continue to use the Service, have an account with us, or for as long as is necessary to fulfill the purposes outlined in this Privacy Policy. We may continue to retain your Personal Information even after you deactivate your account or cease to use the Service if such retention is necessary to comply with our legal obligations, resolve disputes, prevent fraud and abuse, enforce our Terms or other agreements, or protect our legitimate interests. Where your Personal Information is no longer required for these purposes or you request its deletion (for example, by requesting the deletion of your account from the preferences screen in our mobile application), we will destroy it within a reasonable timeframe following your request.
When an account is deleted, certain (non-personal) data may be retained, and all personal data is replaced with identifiers (IDs). This is referred to as the account being anonymized.
Please note that this policy on the retention of Personal Information is aligned with Quebec’s Loi 25 (Nouvelles dispositions protégeant la vie privée des Québécois).
9. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
We understand the importance of information security. We use physical, administrative, and technological safeguards to help protect the Personal Information under our control against accidental or unlawful destruction, accidental loss, unauthorized alteration, disclosure, or access, misuse, and any other unlawful form of processing. Examples of such measures include restricted access to offices, the use of strong passwords, two-factor authentication (Passkeys when available), and data encryption (for both storage and transmission).
We cannot, however, warrant or guarantee that such instances will not occur since no method of transmission over the Internet, or method of electronic storage, is 100% secure. As such and, to the fullest extent allowed by applicable law, we disclaim any liability that does not result from our gross negligence or intentional misconduct.
In the event that information under our control is compromised as a result of a breach of security, we will take steps to investigate and remediate the situation and, in accordance with applicable laws and regulations, notify those individuals whose information may have been compromised, as well as the appropriate authorities, in line with Quebec’s Loi 25 (Nouvelles dispositions protégeant la vie privée des Québécois).
10. DO WE COLLECT PERSONAL INFORMATION OF MINORS?
We do not intentionally gather Personal Information from Website visitors who are under the age of 13. Minors who are at least 13 years old but are under 18 years old may use a parent or guardian’s Partage Club account, but only with the involvement of the account holder. If a child under 13 submits Personal Information to Partage Club and we learn that the Personal Information is the information of a child under 13, we will attempt to delete the information as soon as possible.
11. WHAT ARE YOUR RIGHTS IN CONNECTION WITH YOUR PERSONAL INFORMATION?
You can view, edit, or delete your Personal Information for certain aspects of the Service via your Settings page. You may also have certain additional rights, depending on privacy laws applicable to your situation.
We highlight below the main rights made available to individuals as part of privacy laws, but these rights may or may not be available to you depending on where you live and where you are from. Some of these rights are also subject to exceptions.
You may request access and obtain a copy of your Personal Information we have about you upon written request and with proof of identity.
You may challenge the accuracy and completeness of your personal information. If your personal information is incomplete or inaccurate, you may ask that we correct it.
You may withdraw your consent to or restrict the Processing of your personal information, in which case we will cease Processing it.
You may, without prejudice to any other administrative or judicial remedy, lodge a complaint with a regulatory authority if you consider that our Processing of your personal information infringes local laws and regulations.
If you wish to exercise any of the above rights or have any questions or concerns, please contact us in writing and we will respond to your request within 30 days.
12. CAN WE UPDATE THIS PRIVACY NOTICE?
We reserve the right to update our Privacy Policy from time to time in order to adapt it to any changes in applicable laws or our activities. The date of the latest version of our Privacy Policy is indicated at the top of this page. We will notify you of any changes to our Privacy Notice by posting the new Privacy Notice. Any changes will be effective immediately upon posting of the revised Privacy Policy. Your continued use of the Website or submission of new personal information will be subject to the then-current Privacy Policy.
